Facts

On Oct. 19, 2000, a power outage occurred in the West Los Angeles including the area of 6th Street and Crescent Heights Boulevard. At 8 p.m., after several hours, the traffic lights were still not operating. The defendant Tischler's SUV collided with the decedent's Honda. The decedent, Tristan Morby, age 33, succumbed to his injuries three days later. The decedent's spouse and his mother sued the defendant Tischler for wrongful death, and the City of Los Angeles for dangerous condition.

Settlement Discussions

Two mediations were held. The case was finally settled at $500,000; the city paid nil dollars but waived costs.
