Greg Castro was driving a vehicle owned by Roger Betterton, who was also passenger in the vehicle. Castro fell asleep while driving and crashed into a business owned by David Sacks, Sacks-SFP. The accident caused significant damage to the property, loss of inventory and interruption to business. Sacks alleged that the accident forced him to close his store and liquidate inventory, resulting in a loss in profits. Castro and Betterton contended that Sacks' damages were grossly overstated and that they were entitled to an offset of payments made to the subrogation carrier.
