On May 27, 2002, the plaintiffs Norberto Mendez and Elizabeth Mendez, who wore seat belts, were proceeding south on Vermont Avenue in Wilmington in a Honda Accord when a vehicle in front of them stopped suddenly in the middle of the block. The plaintiff Norberto, the driver, was able to stop without hitting the vehicle, but the defendant, driving a Ford Explorer, was unable to stop and rear-ended the plaintiffs' vehicle.
