Facts

On Sep. 29, 2001, Paul Placencia Jr., 25, was a customer at Club Suave 2000 in Modesto. At about 1:45 a.m., after last call, Placencia was walking near the club's parking lot when he was struck by an unidentified person and knocked to the ground. His head struck the asphalt and his skull was fractured. He died three days later. Placencia's parents, plaintiffs Patsy and Paul Placencia, sued the nightclub, its owner, Josefina Valdez, and the real property owners, Jung K. Lee and The Lee Family Trust, alleging premises liability and negligent security.

Settlement Discussions

The plaintiffs demanded $500,000. The defendants did not make an offer.

Damages

The plaintiffs claimed non-economic damages for the wrongful death of their son.

Other Information

Prior to mediation, the plaintiffs settled with defendants Lee and The Lee Family Trust for $50,000. After mediation, the plaintiffs agreed to settle their claim against defendants Club Suave 2000 and Valdez for $475,000.
