Cindy Reading, a mortgage broker, was a passenger in a 1991 Ford Mustang traveling on Dublin Boulevard in Dublin. Her vehicle was rear-ended by a 1990 Cadillac Eldorado driven by Blesilda Igtiben. Reading sued Igtiben for vehicular negligence. Igtiben disputed the nature and extent of the injuries claimed by Reading. A defense experts contended that the accident occurred at approximately 5 mph and that Reading's body was moved slightly from the accident. Reading's injury from the accident would have resolved within six to eight weeks.

Reading demanded $12,000. Igtiben offered $4,001 C.C.P. Section 998.

Reading claimed soft-tissue injuries to her neck and left shoulder. She was diagnosed with cervical strain. Reading received physical therapy and was referred to Steven Hickey, a chiropractor with whom she began a course of treatment one and a half years after the accident. Hickey testified that Reading's injuries were from the accident.
