Facts

Plaintiff Tracy Potts missed a step on a stairway in a building owned by defendant Spieker Properties. As a result, the plaintiff suffered nerve damage in her foot and leg. The plaintiff sued the defendant for premises liability, contending that the stairway was a dangerous condition because the last step was the same color as the carpet on the floor. The defendant denied the allegation.

Injuries

The plaintiff developed chronic, permanent RSD in her right leg. The defendant contended that the condition resolved after one year of treatment.
