PLAINTIFF'S CONTENTIONS:
Active.com allows runners, cyclists, and outdoor enthusiasts to sign up for various races and sporting events nationwide. Often, Active.com is the exclusive means to register for many activities online. Defendant allegedly charged purchasers annual memberships without properly disclosing that purchases would be subject to annual membership fees. Plaintiff contended that such practice violated California consumer laws.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations.
Result
The parties reached a settlement in which Active Network agreed to fully reimburse eligible members. The total settlement amounted to $1.25 million.
