On January 4, 1992, Plaintiff, a 25-year-old marketing representative was driving his automobile eastbound on I-980 in the City of Oakland California. As Plaintiff proceeded past the 18th Street under crossing Defendant driver was also in the eastbound I-980 in the number 2 lane and driving a large tractor with a tanker trailer. Defendant changed lanes into the path of Plaintiff's auto. Defendant collided with the left rear quarter panel of Plaintiff's vehicle. Plaintiff spun out of control and into the center divider. Defendant was cited for violation of Vehicle Code Sec. 21658 (a) by the CHP.
