PLAINTIFF'S CONTENTIONS:
Defendant allegedly failed to comply with the law by declining to redeem for cash gift cards containing less than $10.

DEFENDANT'S CONTENTIONS:
Defendant denied the allegations.

Result

The parties agreed to a settlement. Lorna Jane agreed to update its policy to help ensure compliance with the law and post a notice stating that it would honor requests to redeem gift cards with less than $10 for cash payout. Lorna Jean also agreed to provide $9.99 in store voucher to eligible class members who have tossed their cards because they were previously told they could not receive a cash payout.
