Plaintiff Shulames Rose, 92, was a resident at defendant Berkeley East Convalescent Hospital between October and November 2011.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that she developed a Stage IV bedsore as a result of neglect, including failure to safely and adequately monitor, assess, and evaluate her for the risk of bedsores, and failure to adequately treat the bed sore once developed.
DEFENDANT'S CONTENTIONS:
Defendant claimed that the care and treatment of plaintiff was adequate and that she was not neglected by defendant's staff.
Injuries
Rose developed an infected Stage IV bed sore during her residency, which led to approximately 16 months of painful debridement procedures and wound care. Plaintiff also claimed dehydration, physical pain and emotional distress.
Result
The case settled for $1 million policy limit.
