Facts

On November 19, 1991, Plaintiff, age 50 years, was working as a conductor on a cable car line. As the cable car approached an intersection, an employee of Defendant rental car agency, driving a rental vehicle, made a right turn and collided head-on with the cable car. Plaintiff, standing at the time of the collision, braced himself with his right arm, to prevent a fall. The cable car gripman and passengers were not injured.

Plaintiff contends his demand was $837,000 and Defendant offered $100,000 increased to $200,000.
