On February 1, 1992, Plaintiff Dennis Borgens, a 49-year-old delivery-truck driver, was unloading a king-size mattress from his truck at Defendant Seattle Sheraton Hotel's loading dock. Plaintiff led with one end and his partner followed with the other. As Plaintiff was backing up on the dock, he tripped over a hand cart which had been left in his path. He fell on his back and sustained injury.
