On Aug. 28, 1995, plaintiff Jorge Rayo, an 8-year-old boy, was riding his bicycle near the intersection of Amesti Road and Vallecitos Lane. Defendant was driving on Amesti road and hit plaintiff, causing him injury. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
