'On July 25, 1994, plaintiff Hubert W. Reese, a 40-year-old retail manager, entered an elevator on the fifth floor of the Oakland Kaiser Hospital. The elevator stopped suddenly during its descent and came to a rest at the ground floor level, trapping plaintiff for over an hour. The plaintiff claimed that the elevator crashed into the elevator pit, causing him serious injury. The plaintiff brought this action against defendants Kaiser Foundation Hospital and Montgomery KONE Inc., the elevator manufacturer, based on a negligence theory of recovery.
