Facts

On May 16, 2000 at approximately 7:20 a.m., plaintiff Lois Blair was driving with her husband, Donald Blair, southbound on State Route 23 between Fillmore and Moorpark. A cement mixer was driving northbound at the same time. As the mixer rounded a curve, it overturned and collapsed onto the Blair's vehicle. Donald died and Lois was injured.

Injuries

Lois suffered a fractured hip, wrist, hand and foot, a torn rotator cuff, and multiple lacerations and abrasions.

Result

The defendant was granted design immunity.
