Facts
On July 15, 1995, plaintiff, a 44-year-old mail carrier, was bitten by defendant's dog as she approached defendant's house to deliver mail. The dog, a labrador/mix, had been on the driveway with the owner, unleashed, when it ran toward plaintiff and jumped on her. The plaintiffs, husband and wife, brought this action against defendants dog owners and the owner of the house (defendant leased the property) based on negligence and strict liability theories of recovery. Plaintiff husband claimed loss of consortium.
Settlement Discussions
No offers or demands were made prior to the settlement conference. Per defendant, plaintiff demanded $25,000 at the mandatory settlement conference.
Damages
The plaintiff's medical bills were less than $500 and she did not claim any lost earnings.
Injuries
The plaintiff suffered a dog bite leaving two scars below her right breast about + inch in diameter.
Other Information
The settlement was reached approximately one year and five months after the case was filed. SETTLEMENT CONFERENCE: A mandatory settlement conference was held on Dec. 16, 1997, before retired Judge Michael B. Rutberg, resulting in the reported settlement.
