On Sept. 10, 1995, plaintiff, a 56-year-old mail courier, slipped and fell in the bathtub at defendant's hotel. The bathtub did not have a rubber mat or safety strips. The plaintiff brought this action against defendant based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $200,000. The defendant offered nothing.

Damages

The plaintiff claimed $177,481.77 in medical bills.

Injuries

The plaintiff claimed a herniated disc, laminectomy and fusion.

Other Information

The settlement was reached approximately two years and three months after the case was filed. A mediation was held on Dec. 15, 1997, before the Hon. D. Robert Fratianne, retired of Alternative Resolution Services resulting in the reported settlement.
