On Dec. 8, 1995, plaintiff, a 69-year-old key maker, was driving southbound on La Brea near 3rd Street when the defendant rear-ended his vehicle. The plaintiff contended that the defendant was inattentive and caused his injuries. The defendant contended that the plaintiff exaggerated his injuries and had pre-existing injuries not caused by this accident. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
