On Jan. 17, 1994, plaintiff insured made her initial claim to defendant insurance company for earthquake damage sustained during the Northridge earthquake. The defendant claimed the damage was below the deductible and denied the claim. When plaintiff attempted to make a supplemental claim in late 1995, defendant denied the supplemental claim as barred by the one-year statute of limitation. The plaintiff brought this bad faith action against defendant based on a breach of contract theory of recovery.
