Facts

On March 23, 1997, the decedent, a 3-year-old girl, was playing in the street next to the sidewalk. The defendant driver was in the process of backing her Ford van out of her driveway when she drove over the decedent child. Unaware that she backed up over a child, the defendant put her van into drive and drove over the child a second time. The plaintiffs, the decedent's parents, brought this action against defendant based on a negligence theory of recovery.

Settlement Discussions

After conducting an extensive financial background investigation of defendants, plaintiffs made a C.C.P. º998 settlement demand for $100,000 (policy limits). The defendant made a C.C.P. º998 offer of compromise for $100,000.
