Facts

On June 2, 1996, the plaintiffs supplied earthquake valves to defendants for construction of a project. Per defendant, it initially rejected the valves but, after receiving approval from the owner, the valves were ultimately installed almost one year later. After plaintiffs received only partial payment, the plaintiffs brought this action against defendants under the Miller Act. The plaintiffs claimed defendants owed $104,000, plus interest and attorney fees. The defendants claimed that because materials supplied were not ordered or defective, no money was owed.
