Facts
On November 29, 1986, Plaintiff mother (Souad Elfahil, 47 years of age) and Plaintiff son (Raad Elfahil, 15 years of age) were detained and eventually arrested at Defendant K Mart Corporation's store by individual Defendants Stephen Pritikin and Robert Jones, both loss-prevention agents for the store. Plaintiff father (Emil Elfahil, 50 years of age) was arrested by L.A.P.D. for assault with a deadly weapon for burning Defendant Pritikin with a cigarette, while being asked to leave the store. The juvenile was not prosecuted, the mother and father were acquitted of theft and battery charges.
Settlement Discussions
Defendants contend they offered $20,000 and Plaintiffs' last demand, during trial, was $500,000.
Damages
Plaintiff sought compensatory and punitive damages.
Injuries
Severe emotional distress including fear, apprehension, anxiety, and sleep disorders. Plaintiffs claimed that they were unable to seek treatment for their injuries due to lack of funds.
