Plaintiff, a minor, sued the Los Angeles Unified School District and others after she was injured following an altercation with another student.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that the altercation was bullying and the teachers and faculty were aware of the history of bullying by a particular student and their response was inadequate. Plaintiff contended that defendant was liable for her injuries.

Injuries

Plaintiff contended that she fractured her right wrist at the distal radius and ulna.

Result

The parties entered into an undisclosed high-low arbitration agreement. The arbitrator's award was in excess of the maximum allowed by the agreement, but pursuant to the agreement, settlement ensued in the amount of $55,000.
