Facts

Elaine Gabat, Emilita Gabat, and Erwin Gabat sued the City of Los Angeles, in connection with the death of 56-year-old Edgardo Gabat in a bicycling accident.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs were the decedent's survivors. On Aug. 21, 2014, the decedent was riding his bicycle with his evening riding group along Colorado Blvd. in Eagle Rock, when he hit a patch of uneven pavement and was thrown off from his bike and died. The decedent, an experienced cyclist, was wearing his helmet at the time of the crash.

Result

The city agreed to settle the matter for $4.5 million.
