Facts

Plaintiff sued AT&T Inc. and Southern California Edison Co. after his neck struck a down power line while he was riding his bicycle shortly after midnight, resulting in serious injuries.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants were liable for his injuries because they failed to make regular inspections of their electrical poles and because they likely caused the down power line.

DEFENDANTS' CONTENTIONS: Defendants contended in its motion for summary judgment, it lacked actual or constructive notice of the down power line, and therefore, could not be held liable for plaintiff's injuries.

Result

The court granted defendants' motion.
