Facts

The plaintiff was the homeowners association of a two-unit condominium complex located in Hermosa Beach that was built in 1991. In 1993, plaintiffs began noticing water intrusion in the units. The plaintiff brought this action against the developer and general contractor based on negligence and breach of contract theories of recovery. The sole issue was the method and cost of repairs.

The plaintiffs claimed $130,000 in damages plus $10,000 attorney fees and costs.
