Facts
On Aug. 21, 1996, plaintiff, a 40-year-old medical office assistant, was driving with her two minor children and one of their friends on Hillcrest Drive. The plaintiff made a left turn in front of defendant. According to three witnesses, defendant's speed was stated to be 85-90 mph. These witnesses were driving their vehicles approximately + mile before the accident when defendant's vehicle and another vehicle raced past them. The plaintiff brought this action against defendant driver and the city based on a negligence theory of recovery.
Settlement Discussions
The plaintiffs made a C.C.P. º998 settlement demand for $100,000 against defendant driver. The city defendant made a C.C.P. º998 offer of compromise for $10,000.

Injuries
Plaintiff claimed she suffered injuries to her face, head, arms, elbows, legs, chest area, both hips, lower back, shoulders and neck, emotional distress. One minor plaintiff suffered back, neck injuries, internal injuries (spleen and small bowel), severe bruising on face and nose, emotional distress and stomach disorder. Another minor plaintiff suffered a head cut open to skull, brain swelling, neck injuries, emotional distress and headaches.

The settlement was reached approximately one year and nine months after the case was filed.
