Facts

On January 23, 1993, Plaintiff 4-year-old girl (3-feet tall) walked or ran through a gap in the hedge at Defendant driving range and golf course. The 4-foot hedge separated the driving range from an 11-foot-wide paved road used by the pro-shop vehicles and pedestrian golfers. The child entered onto the roadway and was struck by a Landrover utility vehicle owned by the Defendant.
