Facts

In 1990 Plaintiffs husband and wife contracted with Defendants to build a custom home in Orange County; completion to be in 9 months and at a price of $380,000. After one year and paying approximately $175,000, only 70% (approximately) of the foundation had been completed by the contractor and various subcontractors; in addition, 4 framing components had been left to rot. The prime contractor eventually went bankrupt in late 1993.

Settlement Discussions

Plaintiffs contend their demand was $300,000 reduced to $270,000; and Defendants offered $175,000 increased to $255,000 overall.

Damages

$300,000 in completion and delay damages.
