Facts

In early 1993, Plaintiffs purchased a homeowners insurance policy from Defendant insurance company. In November, 1993, Plaintiff's home was damaged as a result of wind driven rain. On November 29, 1993, Plaintiff submitted a claim to Defendant insurance company under the homeowners policy. The claim was denied on the basis that the damage to Plaintiffs' home occurred over a period of time and, as such, did not constitute an occurrence under the terms of the insurance policy.

Settlement Discussions

Defendant offered $30,000; Plaintiff demanded $30,000.

Damages

$30,000 repair to Plaintiffs' home for rear corner of home.
