Facts

On October 15, 1993, the defendant taxi driver picked up a fare at a hotel at Convention Way; headed westbound; made a U-turn to go east; and struck the plaintiff, a 48-year-old business man. The plaintiff had attended a convention and was walking across Convention Way from another hotel near a "T" intersection which did not have a cross-walk, traffic control, or warning signs.

Settlement Discussions

The plaintiff made a demand for $250,000 to the defendant city who offered $15,000. Other settlement discussions were not disclosed.

Injuries

C-6 compression fracture brachial plexus; left shoulder rotator cuff injury; and a fractured coccyx. The plaintiff had surgery on his shoulder, and required surgery of the coccyx.
