Facts

On November 27, 1994, the plaintiff, a 37-year-old institutional salesperson of investment services, was terminated in retaliation for complaining of sex discrimination. The plaintiff was hired in January, 1992, and was assigned to a male national sales manager who began to criticize her assertive behavior as "unattractive." The plaintiff alleged that she complained to human resources and was told to try and understand men and "enthrall" them; the vice president compiled a report to the chairman which confirmed that two other complaints of sex discrimination against the defendant manager had been lodged and that employees were not given an "equal opportunity:" and an outside consulting firm's study further confirmed that differing standards of treatment for men and women were perceived and that an environment existed at the company which was "corrosive" to women. The plaintiff also alleged that she continued to seek resolution to the unfair terms and conditions of her employment, including inequitable sales territory assignments directly with the company through August, 1994, and at that time, her request for a transfer from the manager was denied. The plaintiff further alleged that three days after she submitted a response to a blistering performance review by the defendant manager, the plaintiff was terminated. The plaintiff brought this action against the defendant based on sex discrimination and retaliation, violation of public policy and breach of implied contract theories of recovery.
