Facts

On Feb. 22, 1990, the plaintiff, a 42-year-old waitress, presented to her doctor for an annual check-up. The plaintiff's pap smear was misdiagnosed by the laboratory, resulting in a 16-month delay in diagnosis of cervical cancer which resulted in a radical hysterectomy, chemotherapy and radiation therapy. The plaintiff brought this action against the defendant pathology laboratory based on a medical negligence theory of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $300,000. The defendant accepted.
