Facts

During 1985 through 1990, the decedent, a 28-year-old homemaker and mother of two minor children, had a series of pap smears that were misdiagnosed by the defendant pathology laboratory. The pap smears were read as negative. The decedent suffered a 24-month delay in the diagnosis of cervical cancer which resulted in her death. The plaintiff, the decedent's husband, brought this wrongful death action against the defendants, a number of pathologists and the laboratory, based on a medical negligence theory of recovery.

Settlement Discussions

Per the defendants, the plaintiff's initial settlement demand was $7.5 million. The plaintiff made a later settlement demand for $800,000. The defendants accepted.

Death of wife and mother.

Other Information

The settlement was reached approximately one year and four months after the case was filed.
