Facts

During 1992, the plaintiff, a 34-year-old businesswoman and mother of two minor children, had two pap smears misdiagnosed by the defendant pathology laboratory. The pap smears were read as negative, resulting in a 12-month delay and a 10-month delay in diagnosis of cervical cancer. The plaintiff brought this action against the defendant based on medical negligence theories of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $300,000. The defendant accepted.

Injuries

The plaintiff claimed she underwent a hysterectomy and was denied the opportunity to have more children; and that had the pap smear been correctly read, she would have had an early diagnosis and a complete cure with a simple surgery.

Other Information

The settlement was reached approximately four months after the case was filed.
