Facts

On June 22, 1995, the plaintiff, a 53-year-old men's apparel distributor, entered the defendant grocery store intending to buy soft drinks. The plaintiff claimed that he tripped and fell on an unassembled display on the floor. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $200,000. Per the plaintiff, the defendant made a C.C.P. º998 offer of compromise for $80,000.
