Facts

On June 16, 1997, at 5 p.m., plaintiff, a 24-year-old management assistant was walking westbound on a sidewalk in Beverly Hills. As she crossed an alleyway she was struck by defendant's Volvo headed northbound in the alley. The plaintiff brought this action against defendant based on negligence and negligence per se theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $100,000 (policy limits). The defendant made no offer.

Specials in Evidence

Per defendant, medical expenses were in excess of $37,358. $4,500, per plaintiff.

Injuries

The plaintiff suffered a compound fracture to her left leg requiring open reduction and internal fixation with a rod.

Other Information

The settlement was reached approximately five months after the case was filed.
