Facts

On Sept. 29, 1996, the plaintiff, a 72-year-old retired woman, was driving westbound on Rodeo when she was rear-ended by a police vehicle. The plaintiff brought this action against the defendant based on a negligence theory of recovery. The defendant admitted liability. The plaintiff contended that the defendant was negligent and this was the cause of her knee injuries. The defendant contended that the plaintiff had pre-existing knee problems and defendant was not the proximate cause of any injuries.

Settlement Discussions

The plaintiff made a settlement demand for $125,000. The defendant made an offer of compromise for $65,000.

Damages

The plaintiff claimed $34,000 in past medical bills, and $25,000 in future medical expenses.

Injuries

The plaintiff claimed injuries to her knee requiring future patellar replacement surgery.

Other Information

The settlement was reached approximately 11 months after the case was filed. ARBITRATION: An arbitration was held before Sanford Jossen, resulting in an award of $125,000 to plaintiff. The defendant requested a trial de novo.
