Facts

The plaintiff was an over 40 female contracts manager with five years experience with the defendant employer. The plaintiff alleged she was the victim of harassment and discrimination by her immediate supervisor for nine months up to January 1994. The plaintiff was terminated in April 1994 for alleged cutbacks, but was the only one in her department to be let go, including employees with less seniority. She had continuously good or above average evaluations until 1994, when she received a fair rating by a supervisor of less than four months. The plaintiff alleged, that among other things, her immediate supervisor shook her violently by the shoulders, choked her, shook his fist in her face, told her he would kick her a - - up to her shoulders, accused her of sleeping at her work station and kicked her door. The plaintiff brought this action against the defendant based on gender discrimination.

Settlement Discussions

The plaintiff indicated that the case could settle for six figures within one month of the settlement. The defendant offered nothing until the day of the first deposition taken by plaintiff's counsel. The case settled within five days of the first deposition.

Injuries

The plaintiff alleged emotional distress, visits over a several year period of time to a psychiatrist and psychologist, with the need for future psychological counseling. Plaintiff had obtained treatment for emotional and physical injuries arising out of on the job incidents, and did receive a workers compensation award based upon the alleged emotional distress from the alleged harassment.

Other Information

The settlement was reached approximately one year and three months after the case was filed.
