Facts

The plaintiff, a tenant in defendant's apartment building slip and fell in water that had accumulated on the landing of the second floor staircase. The plaintiff had complained to the owner's representative about the other tenant overwatering the plants on the landing which caused water to accumulate. The owner took no action to correct the problem. The plaintiff slipped and fell on the stairs causing injury and $12,000 in medical bills. The pain from the injuries kept plaintiff from working resulting in a loss of approximately $20,000.

Settlement Discussions

At the mandatory settlement conference, the plaintiff offered to settle for $100,000.
