Facts
On March 26, 1997, plaintiff, a 45-year-old unemployed martial arts teacher was leaving a Century City
Shopping Center parking lot on a motorcycle, with a 13-year-old passenger. The plaintiff had not taken a ticket
on the way into the lot; the gate had been lifted for him.
En route out, the plaintiff claimed the attendant told him to go on through the gate. The gate came down on
plaintiff and his passenger. There was no property damage. The motorcycle did not fall over.
The defendant claimed that the plaintiff tried to "beat the gate." The defendant also contended this was a non-
incident, not reported by plaintiff until later. The plaintiff was not injured.

Injuries
The plaintiff sustained a tear, to the posterior cruciate ligament, bursectomy, alleged tear to the right elbow, right glenoid (diagnosed 10 months later) and soft tissue injuries.
