Facts

Defendants hired plaintiff, age 21, to paint the outside frame of a second floor window. While standing on the
sloping tile roof, defendant lost his balance and fell 8-10 feet to the concrete floor below.
The plaintiff landed on the right side of his head, face, shoulder and leg. The plaintiff was knocked
unconscious for approximately 15 minutes.
As a result of the fall, the plaintiff suffered multiple skull fractures, an intercranial hematoma, cerebral
concussion, fracture of the right orbit and post-traumatic head injury syndrome.

Settlement Discussions

On Dec. 15, 1999, the plaintiff demanded policy limits of $301,000. On December 22, the defendantsÆ carrier agreed to pay the policy limits.
