Facts

Plaintiff was a 17-year-old high school student who was employed for four months as a part-time cashier earning minimum wage at an auto parts store. She sought damages from the corporate store owner, as well as from the former manger who terminated her. Although he was elevated to the manager position only days before terminating plaintiff, the individual defendant wore a shirt with ôSupervisorö stitched above the pocket the entire time that plaintiff was employed there. He was engaged to, and did subsequently marry, another of the cashiers.
Plaintiff claimed that defendant sexually harassed her by putting his hands on her thigh at a restaurant, bragging about the size of his genitals, lifting her over his shoulder and inquiring what type of panties she wore.
Defendant terminated plaintiff less than a week after he replaced the former manager.

Settlement Discussions

At mediation, plaintiffÆs opening demand was $55,000. DefendantÆs opening offer was $10,000.

Damages

Plaintiff sought compensatory damages for emotional distress, as well as punitive damages and attorneyÆs fees under FEHA.

Other Information

The matter was settled prior to the commencement of a lawsuit.
