Facts

The plaintiff, age 42, driving a Chevrolet pick-up truck, was stopped at an uncontrolled intersection, waiting to make a left turn. The defendant, age 16, driving a Mazda Sedan, was proceeding in the same direction as the plaintiff. While the defendant was driving at approximately 50 to 60 mph, he rear-ended the plaintiff's vehicle, causing substantial damage to the truck. The defendant's car was totaled and he was cited by local authorities.

Settlement Discussions

The case settled in seven months.

Damages

The plaintiff missed more than a year from work. Lost wages at the time of settlement were approximately $25,000. Medical special damages at the time of settlement were approximately $80,000.

Injuries

The plaintiff sustained a disc herniation at L5 that required surgery. Also, the accident exacerbated plaintiff's pre-existing hip condition.
