Facts

The plaintiff, age 52, was a senior manager at a large Southern California company for 19+ years. The plaintiff
was laid off in September 1999, as part of a 40 person layoff.
Prior to the layoff, the plaintiffÆs former supervisor retired.
His new supervisor, who the defendant contended was not the decision maker, made derogatory comments
about the plaintiffÆs age and national origin. He also excluded the plaintiff from management meetings.
Further, the plaintiffÆs performance evaluation was downgraded five days before he was laid off.
The defendant claimed that the plaintiff was an "at will" employee due to his signing a handbook. The
defendant also argued that the plaintiff was laid off due to a significant decline in business.

Settlement Discussions

The plaintiff demanded $350,000. The defendant offered $70,000.
