The accident occurred on June 10, 1998, at approximately 6 a.m. in Westlake Boulevard and the southbound off ramp to the 101 freeway. The plaintiff driver was operating a company van that was occupied by plaintiffs B and C. The plaintiff driver had exited at Westlake Boulevard off ramp and was traveling southbound on the 101 freeway. The van entered the intersection on a green light. The defendant was operating her 1993 Toyota Camry on northbound Westlake Boulevard in the number two lane of traffic when she entered the intersection at the same time as plaintiffs. As a result, a collision occurred, causing the van to spin out and collided into a raised center median at the entrance of the Westlake Hyatt Hotel. The defendant's vehicle hit the center median at the entrance to Westlake Hyatt Hotel. Plaintiff B is claiming personal injuries and damages as a result of the accident. The plaintiff driver and plaintiff C have resolved their claims and are no longer parties to this matter. Plaintiff B claimed that he should be compensated accordingly. The defendants contended that plaintiff B had recovered from his injuries.
