On Aug. 5, 1999, the plaintiff's car was struck in the side by defendant's car that allegedly ran a red light. The plaintiff suffered injuries including facial contusions and subconjunctival hemorrhage, contusion and abrasion on his forearm, lumbosacral sprain and sprain of the left knee. The plaintiff's conditions improved with treatment. On Nov. 10, 1999, his car was rear-ended by a hit and run driver. The plaintiff suffered additional and aggravated injuries including contusions of both knees and a lumbosacral sprain. The plaintiff filed an action for personal injuries arising from the first accident and submitted an uninsured motorist claim for injuries arising from the second accident. The plaintiff claimed the accidents aggravated pre-existing conditions, prolonging treatment. The defendants claimed that the medical specials were largely diagnostic and partially attributable to treatment of pre-existing conditions. The plaintiff was previously under medical care for pre-existing lumbar spinal stenosis and other ailments. Health care providers estimated that one third of plaintiff's treatment related to pre-existing conditions, one third related to the first accident and one third related to the second accident.
