Facts

The plaintiff homeowners association, contended that the 243-unit residential condominium complex located in
Anaheim Hills had experienced water intrusion through the windows and roofs.
The plaintiff also alleged various structural, electrical and plumbing deficiencies. The defendant filed a cross-
complaint against the subcontractors which constructed the condominium units.
The plaintiffÆs cost of repair estimate was in excess of $12 million. The defendant estimated the repair costs to
be less than $2 million. The case proceeded through all phases of discovery, numerous mediations and to the
beginning of trial.
Following the second day of jury selection, all parties participated in a mediation, at which time the settlement
was reached.

Other Information

<M>The final mediation session was conducted before Ross Hart of the American Arbitration Association. The defendant paid $706,190 of the total settlement.</M>
