The plaintiff, age 34, was hired by defendant in November 1995. About six years prior to her termination, she was diagnosed with Takayasu's Arteritis, a rare disease which results in inflammation of major blood vessels. By August 1997, her diseased progressed. At that time, she requested and was granted leave to have surgery. She was out for approximately six weeks. She return in mid October 1997. In August 1998, she again requested leave to have a second surgery performed. This second request was granted. However, she was terminated on Sept. 23, 1998.
Settlement Discussions
The plaintiff demanded $245,000. The defendant offered $5,000.
Other Information
Barbara Morris, the CEO of RDL, moved for summary judgment as no evidence of harassment existed to hold her individually liable to plaintiff. The case was mediated before Viggo Boserup.
