Facts

On Feb. 25, 1998, the plaintiff first presented to Dr. KrikorianÆs office. The plaintiff had diabetes, was a smoker
and had a heart attack in the past. The plaintiff was treated by Dr. Krikorian for his diabetes and, throughout
the ensuing months, various studies were recommended to determine the extent of the plaintiffÆs coronary
artery disease.
A thallium stress treadmill test was recommended in April 1998, which the plaintiff refused to have done.
Thereafter, when the plaintiff returned to Dr. KrikorianÆs office on Aug. 5, 1998, with increased coronary artery
disease symptoms, the thallium stress test was again recommended although the patient was reluctant to have
the test scheduled. The thallium study was finally obtained on August 12. The interpretation of the thallium
study was provided to Dr. Krikorian on August 14, and it was noted that the plaintiff would be referred to a
cardiologist for an angiogram.
However, before the referral took place, the plaintiff experienced a heart attack on August 16, and was
admitted to Encino-Tarzana Regional Medical Center. An angiogram done showed total occlusion of the left
anterior descending coronary artery with 90 percent occlusion of the diagonal, circumflex and right coronary
artery. The plaintiff then underwent quadruple bypass surgery.
The plaintiffÆs wife claimed loss of consortium. This claim was dismissed before trial.

Settlement Discussions

Manouk Paghikian made a C.C.P. Section 998 demand for $79,999. Madeline Paghikian made a C.C.P. Section 998 demand for $19,499. Prior to trial, both plaintiffs made a C.C.P. Section 998 demand for $29,999. The defendant offered to waive costs and a lawsuit for malicious prosecution in return for a dismissal.
